Your use of the Site constitutes your full acceptance of these Terms and Conditions, as well as our Privacy Policy (#) (linked for transparency). We may update these terms at any time, and continued use after such changes signifies your agreement to the updated version. Notices of changes will be posted on the Site or sent via email.
The Site serves as a vital resource for the business community, offering insights, advocacy updates, and educational content about local transmission providers. As a service to our members, ALERT may feature third-party promotions for products or services. These are governed by the third parties’ own terms of use, and ALERT disclaims all responsibility for their provision, quality, or availability. We encourage you to review those terms before engaging
(a) ALERT grants you a limited, non-exclusive, non-transferable right to access and use the Site for personal, non-commercial purposes. You may not remove any copyright, trademark, or other proprietary notices. Your use of such sites is at your own risk.If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.
(d) ALERT provides no warranties regarding third-party sites, disclaiming all implied warranties (e.g., merchantability, fitness for purpose, title, non-infringement). We are not liable for the quality, safety, or suitability of information, services, or goods found there.
(e) You may not transmit or use material that violates these Terms, U.S. or international laws, or third-party rights. This includes copyrighted material, defamatory content, obscene material, or anything infringing on privacy, trademark, trade secret, or patent laws.
Data or content you upload or provide to ALERT (“User-Submitted Data”) remains your property, while data we gather or derive (e.g., usage analytics, “Site Use Data”) belongs to ALERT. We may use User-Submitted Data and Site Use Data to fulfill our services, including advocacy and member support, and share it with trusted third parties (e.g., for market research) under confidentiality terms (see Section 7). You grant ALERT a perpetual, royalty-free license to use, reproduce, modify, and distribute User-Submitted Data for these purposes.
The Site is provided “AS IS” without warranties of any kind. ALERT and its licensors disclaim all guarantees regarding uninterrupted access, security, accuracy, completeness, or error-free performance. You assume full responsibility for evaluating the Site’s content.

To the fullest extent permitted by law, ALERT, its officers, directors, employees, licensors, and suppliers shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Site, reliance on its information, or transmission of viruses or harmful code. This includes damages to your hardware, software, or data, even if advised of the possibility.

ALERT commits to protecting the confidentiality of User-Submitted Data per our Privacy Policy (#) and applicable security practices. However, this does not apply to data used internally or shared with third parties as permitted herein.
You agree to indemnify and hold harmless ALERT, its directors, officers, employees, suppliers, licensors, and agents from any claims, losses, damages, costs, or expenses (including reasonable attorney’s fees) arising from:

ALERT will notify you via email, Site posting, or mail. Your notices to us should go to info@energyALERT.org. Consent requiring ALERT’s approval must be in writing from an authorized representative.
Changes to these Terms require written agreement from an ALERT official, except for updates posted on the Site, which bind you upon continued use.
ALERT’s delay in enforcing these Terms does not waive rights. If any provision is invalid, the remaining terms remain enforceable, and parties will replace it with a valid provision reflecting original intent.
These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law principles. Disputes will be resolved in D.C. courts.
These Terms, with the Privacy Policy, constitute the entire agreement between you and ALERT regarding Site use.
